McNiel Auction Services LLC, herein referred to as Auctioneer, reserves the right to deny or revoke any buyer at any time, without notice or consent at their sole discretion. Auctioneers at their discretion will have the final say as to disputes among bidders, including tie bids. Announcements posted or made the day of the auction take precedence over any previous statements or advertisements.

All items are sold "As-Is and Where-Is". The Auctioneer makes no warranty or guarantees, whether expressed or implied. It is the Bidder's responsibility to ascertain the correctness of year, make or model prior to bidding.

An additional 3% surcharge will be applied to any and all credit card and debit card payments.

Payments Options: Cash, Check (Contingent on Auctioneer’s approval), Cashiers Check, Visa, MasterCard, Discover, American Express, Money Order, and Wire Transfer. For Wire Transfer, contact the auction company for payment instructions at 405-702-3202. Auctioneer, at its discretion, may require checks to have a Bank Letter of Credit if amount owed is greater than $2,500. All checks should be made payable to McNiel Auction Services LLC.

All purchases must be settled prior to removing items. If payment or payment arrangements have not been made within the 72hr period following end of sale, the auction company will automatically contact Equipmentfacts to dispute your purchase for online buyers. If paid by check, items will not be removed until check clears, unless prior arrangements have been made with Auctioneer.

Buyer agrees to indemnify and hold harmless Auctioneer and the seller against any and all liability, loss, costs, damages, and other expenses arising from the loading out by Auctioneer and employees on Buyer's behalf of purchased items.

Removal of equipment will begin as soon as payments have cleared. Online bidders that win an item will be emailed an invoice after the auction is complete. If you will need a tax exemption, please email your completed IRS forms within 24 hours of the auction completion to [email protected]. Your invoice will be sent to the email address used when registering to bid online.

All items to be removed from the auction field by August 30, 2025, by appointment only if not removed on sale date. All purchased items become the responsibility of the buyer as soon as the item is sold. Any items not picked up by August 30, 2025 will be charged a storage fee of $100 per day. The Auction company is not responsible for lost or stolen items. Please contact Pecos McNiel at 918-671-3652 to make arrangements for pickup of items immediately after the sale.

If items have not been removed by August 30, 2025, the items become property of the Auction Company with no reimbursements made to the buyer. A bill of sale will be given to buyer at time of payment.

Vehicle Titles: If payment is made by cash, a signed and notarized title will be given to Buyer on day of auction. If paid by any other means, title will be mailed once payment clears to the address on file. A bill of sale will be given to buyer at time of payment.
