By registering as an Internet Buyer, you are agreeing to the following terms and conditions:

1) Buyer will pay a 5% Internet Purchase Fee on the "hammer price" (winning bid amount) for all online purchases.
2) Sales tax at the rate of 5.27% will be added to all purchases (including the buyer's premium) unless the buyer claims the purchase as ag exempt and provides the auction company with the completed Colorado ag exemption affidavit, which can be provided by the auction company. Titled vehicles are not eligible for the ag exemption and Flowers Auction Service, LLC reserves the right to make the final determination on whether and item qualifies for the ag exemption or not with no dispute from the buyer.
3) Payment in full must be made within 2 business days in the form of Cash, Wire Transfer, or Cashier’s Check. Credit card payments on purchases that total less than $1,000 will be accepted after the sale with a 4% transaction fee but must be made within 2 business days by calling Flowers Auction Service, LLC at 970-210-6149.
4) All purchases must be removed from the premises by 10/21/24.
5) Bidders are personally responsible for any bids made with their Bidding Number. If the highest bid for any particular lot is submitted using your Bidding Number, you are responsible and liable for any payments due hereunder, without protest, set-off or claim against Flowers Auction Service, LLC or Equipmentfacts LLC ("Equipmentfacts").
6) The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute Flowers Auction Service, LLC and Equipmentfacts shall have absolute discretion either to settle such dispute as they determine or to re-offer the lot for sale.
7) Neither Flowers Auction Service, LLC nor Equipmentfacts shall be liable for any loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale.
8) You acknowledge and understand that the descriptions of the Lot(s) in the catalogue are provided by Flowers Auction Service, LLC to the best of our ability and are subject to change without notice. Flowers Auction Service, LLC and Equipmentfacts shall not be liable for any deficiencies, misstatements, misrepresentations and/or errors in any description(s), oral or printed, and neither Flowers Auction Service, LLC nor Equipmentfacts guarantee or warrant the authenticity, genuineness, origin, age, condition or quality of any Lot(s), and all statements as to these matters whether contained in the catalogue or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact by the Flowers Auction Service, LLC or Equipmentfacts. All claims against Flowers Auction Service, LLC and Equipmentfacts, and their respective employees and agents, arising out of or related to any Lot description are hereby waived and forever released.
9) Each and every Lot is sold "as-is, where-is." Flowers Auction Service, LLC and Equipmentfacts provide no guarantees or warranties whatsoever, express or implied, in respect of the equipment contained in or constituting a Lot. All representations made by Flowers Auction Service, LLC and Equipmentfacts, as well as their respective employees or agents, are to be considered lay opinions only and neither Flowers Auction Service, LLC nor Equipmentfacts shall be liable for any purchase made by a Buyer in reliance upon them, and all such claims arising out of or related thereto are hereby waived and forever released.
10) The Buyer agrees to insure the equipment or item purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. Neither Flowers Auction Service, LLC nor Equipmentfacts shall have any responsibility or liability whatsoever for or pertaining to the equipment or item purchased once the Buyer has been determined to be the successful bidder.
11) Loading assistance is available on 10/5/24 & 10/6/24 all day. Loading assistance by appointment will be available for up to seven days after the closing of the auction. After that, buyers will be responsible for loading their own items. Items not picked up by 10/21/24 will be transported to another location and re-sold on AuctionTime. Transportation, storage fees and applicable commission will be deducted by Flowers Auction Service, LLC. Buyer is responsible for any deficiency between the re-sale proceeds and the costs mentioned above.
12) Disassembly of equipment is the responsibility of the buyer. If additional assistance is required from Flowers Auction Service, LLC, it will be billed out at $150/hour with a $150 minimum charge.
13) The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth herein.
